1. Acceptance of Terms
By accessing this website, submitting any form, or purchasing any service, you agree to be bound by these Terms of Use. If you do not agree, please do not use this website or our services. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use our services. If you are submitting a form or making a purchase on behalf of a company, trust, or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
Every Step Consulting LLC provides advisory consulting services only, including but not limited to Quick Guidance, New Construction Guidance, Remodel Consulting, and DIY/Owner-Builder Guidance. Every Step Consulting does not perform, supervise, or manage construction work of any kind, and is not a licensed contractor. Decisions made by the client based on guidance provided remain solely the client's responsibility.
3. Nature of Guidance Provided
All guidance is based solely on the information, descriptions, and photographs voluntarily submitted by the client, and does not involve an independent, in-person site visit, inspection, destructive testing, or engineering analysis unless expressly stated otherwise in writing. Guidance provided represents professional opinion based on the information reasonably available at the time and is not a certification, code-compliance determination, or engineering conclusion. Guidance is intended solely for the requesting client and may not be relied upon by any third party without Every Step Consulting's prior written consent.
4. Quick Guidance Payment & Refund Policy
Payment for Quick Guidance is due in full at the time of submission and is processed through our third-party payment processor. Once a client's written guidance response has been prepared and delivered, the service is considered complete and is non-refundable. A full refund will be issued if the client requests cancellation before Every Step Consulting has begun preparing the guidance response. If the delivered guidance does not address the question or concern originally submitted, Every Step Consulting will provide one round of follow-up clarification at no additional charge.
5. Use of Artificial Intelligence in Service Delivery
Every Step Consulting may use AI-assisted tools, including tools developed and maintained internally, to help deliver and improve our services. Final guidance provided to clients reflects the professional judgment of Every Step Consulting and is not generated by AI without human review.
6. No Guarantee of Outcomes
Every Step Consulting provides advisory guidance based on the information and materials provided by the client. We do not guarantee any specific project outcome, cost, timeline, or result, and our guidance should not be treated as a substitute for licensed professional services (including but not limited to contractors, engineers, architects, inspectors, or attorneys) where such services are appropriate or required.
7. Disclaimer of Warranties
Our website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, secure, or error-free.
8. Client Responsibilities
Clients are responsible for providing accurate and complete information. Every Step Consulting is not responsible for guidance that is inaccurate or incomplete as a result of inaccurate or incomplete information provided by the client.
9. Communications
Only guidance delivered in the formal written response constitutes official advice from Every Step Consulting. Verbal discussions, phone calls, text messages, and informal email exchanges — including any follow-up clarification provided under Section 4 — are for general discussion only and shall not be relied upon as final professional opinion unless confirmed in writing as part of a formal guidance response. Every Step Consulting will make reasonable efforts to respond to communications in a timely manner, but does not guarantee immediate response.
10. Intellectual Property
All website content, including text, graphics, logos, and guidance documents prepared by Every Step Consulting, remains the property of Every Step Consulting LLC unless otherwise agreed in writing. Clients may use guidance provided to them for their own personal project purposes.
11. Limitation of Liability
To the fullest extent permitted by law, Every Step Consulting LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our website or services, including but not limited to decisions made by the client based on guidance provided. In no event shall Every Step Consulting's total liability arising out of or relating to these Terms or any service exceed the total amount paid by the client for the specific service giving rise to the claim.
12. Indemnification
The client agrees to indemnify, defend, and hold harmless Every Step Consulting LLC, its owners, and representatives from any third-party claims, damages, or expenses (including reasonable attorneys' fees) arising out of the client's use of our services, the client's sharing of guidance with third parties, or the client's breach of these Terms.
13. General Provisions
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between the client and Every Step Consulting LLC regarding use of this website and its services, and supersede any prior or contemporaneous oral or informal communications on the same subject. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Governing Law & Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or any service provided by Every Step Consulting LLC shall be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring a qualifying claim in small claims court in lieu of arbitration. Arbitration shall be conducted in Arkansas under the rules of the American Arbitration Association then in effect. Disputes shall be resolved on an individual basis only, and no party may bring a claim as part of a class, consolidated, or representative action. Every Step Consulting will pay any arbitration filing fees in excess of the cost of filing a claim in small claims court. A client may opt out of this arbitration provision by providing written notice to info@everystepco.com within 30 days of first accepting these Terms; timely opt-out will not affect any other provision of these Terms. Nothing in this section shall be construed to increase, waive, or otherwise affect the limitation of liability set forth in Section 11.
15. Changes to These Terms
We may update these Terms of Use from time to time. The "Effective Date" at the top of this document reflects the most recent revision. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
